Brownfield and Contaminated Land Site Advice

Brownfields are abandoned or underused industrial and commercial facilities available for reuse, otherwise known as Previously Developed Land (PDL).

The redevelopment of such a facility may be complicated by real or perceived environmental contaminations.

The government has a target that 60% of new housing development must be on PDL, and the overall aim in the country is to recycle PDL in preference to greenfield sites. Regional Development Agencies and English Partnerships help secure and support the regeneration of run down areas.

Contaminated land is dealt with in the UK as a separate issue in planning development control under Part II A of the Environmental Protection Act 1990.

  1. The physical steps you as a developer of land need to take in respect of such a site in order to remediate it to a level to make the land fit for its new proposed use.
  2. The legal processes and documents which have to be obtained from your contractors (in order to satisfy you that the work has been done to a suitable standard), your funders, your potential purchasers and their mortgagees and banks, as well as the planners and other government agencies.
